Fraud Of Bill Of Lading And Study On Its Leagal Strategies

Bill of lading is an important document in international trade, which is a symbol of ownership of the goods. After centuries, the bill of lading have promoted the development of international trade, and made it from barter transactions to document transaction. Since the early twentieth century, the legislation of bill of lading are sepreately of America, British, and three international conventions . The law of bills of lading plays an important role in the regulation of bill of lading. At present, the rampant fraud of bill of lading has seriously affected the basic system of B/L, undermined its credibility and obstructed its development . under the circumstance of the short of our legislation in anti-fraud, this paper find out the reasonable rule for our reference by comparing the American law ,England law and the international Convention on the anti-fraud legislation of bills of lading.This paper analyzes the subjective and objective reasons about the fraud of bill of lading. The second chapter are the main forms of the fraud of B/L. The third chapter is that to find out the reasonable rule for our reference by comparing the American law ,British law and the international Convention on the anti-fraud legislation of bills of lading. There are two part in the forth chapter. The first part is to elaborate the shortcomings of our legislation in anti-fraud. And the second part is the suggestion on practical operation.This paper has concluded the suggestion on how to antifraud by the mean of comparing study and case analysis.
