Infringement Standards Of Automobile Design Patent Research

With the economic globalization, especially since China's accession to WTO, it has been brought so many opportunities for China's automobile industry. It has been forecasted that China's automobile output will be more than the output of U.S. in 2015 by the State Information Center State Information Center forecasts, and the market capacity will be more than 17 million vehicles.In face of various of vehicles, the public's first attention is the appearance of automobile. Then they focus on the automobile appearance design and Design Patent application. Recent years, a lot of automobile Design Patent infringement has been occurred. Also there are several cases related Chinese automobile factory.Till now, the standards of Design Patent Infringement are unclear. The automobile design is firstly introduced in this article. Most of the "original design" are designed based on the "existing design" .Also most of infringing product are made based on the patented product. I hope that "quantitative evaluation system" can be explored.Then, based on the analysis of Design Patent protection and Design Patent granted principle, and analyzes the core standards of Design Patent Infringement: the whole and the part appearance. This is different in authorization process and infringement process. And this research is very important.Finally, based on the analysis of Patent Reexamination Board and court verdict. Then the criterions of Design Patent Infringement are further analyzed.
