In recent years, the number of the Manpower Search Engine participants is increasing fast. The information resources are more extensive and the speed of collection is faster. The surprising social impact brings both positive function of supervision and negative effect, which lead to countless controversy. On one hand, the Manpower Search Engine that can shock and awe some illegal or immoral behaviors shows the freedom of speech. On the other hand, the operation of Manpower Search Engine may infringe on other citizens'portrait, privacy and reputation. Because of the huge number of participants including the internet service provider, the complex behavior process, and long lasting period, there are so many legal problems in the tort liability. Up to now, there is no clear regulation about the Manpower Search Engine and its tort liability in our country. It does not adapt the modern network environment for legislation demands. So, the study of the Manpower Search torts is very valuable, and this thesis studies as this background.This thesis includes following aspects: (1) It discusses the feature and three operating processes of the Manpower Search Engine, summarizes its three main theory points of the civil liability and comments on its limits. (2)With three operating process of the Manpower Search Engine,the thesis discusses the possible tort construction of the Manpower Search behaviors and tort liability for the internet service provider. (3) It expounds three special excuses of Manpower Search torts which are different from common torts. (4). It discusses the present situation and defects of legislation in our country. For example of"the first case of Manpower Search", expounds the limits of judicial practice. And it presents the suggestion of completing the legislation about Manpower Search.
