Reserch On The Issues Of Imformation Network Dissemination Right Of Digital Library

Digital library is a kind of novel things,the problem of it's imformation network dissemination right was not been fully sloved in the current judicial practice.In china, Regulations for the Protection of Imformation Network Dissemination Right was issued not a long time, in this context, the study of the ways to solve the problem of information network dissemination right of digital library not only has theoretical significance, but also has practical significance.After the analysis of the main problems of information network dissemination right of digital library and the introduction of circumvention, this article made a comparison and analysis of information network dissemination right protection legislation of international convention and other countries. Also, this article tried to give some recommendations on the solution of the problems of information network dissemination right of digital library and some suggestion of the modification of some relevant provisions of Regulations for the Protection of Information Network Dissemination Right. The goal is to promote the construction of legal system, and thus to contribute to the rapid development of digital library.An important point is that some terms of fair use in Regulations for the Protection of Imformation Network Dissemination Right should be modified, and we should expand the scope of fair use of digital library. Based on the reality and the principle of interests balance, to establish limited implied licensing system is a good way to solve the problems of the author's licensing authority to digital libraries, also, this method will contribute more to the respect of author's personality rights. We must first improve the system of collective administration of copyright, then all these goals can be achieved.
