Study On The Method And Application Of Dealing With The Medical Dispute With The Model Of Three Party Cooperation

In recent years, China's medical and health services made great progress, but due tovarious reasons, medical disputes occurred frequently, doctor-patient conflictescalated gradually. The medical dispute, which is the "persistent ailment" ofmedical profession, not only has become a greatest trouble for the managers ofmodern hospital, and but also directly affected people's life safety, the happiness ofthe family and social stability. The medical dispute has become a hot spot in today'ssociety, and the doctor-patient relationship from the background of the society wasasked to the front desk, especially on 1 April 2002, the supreme people's court enactedthe《Regulations on civil action evidence》, in which the shifting of burden ofevidence was issued, and in September 2002, the《medical accident treatment pour》was enacted, and on July 1, 2010,the《tort liability law》was implemented, and then thedomestic medical disputes increased significantly.Nowadays, on one hand, many domestic studies and articles about medical disputespayed more attention to the theoretical research, while omit the feasibility of thepractical manipulation. One the other hand, the research on the medical disputemostly aimed at the single role of the society, however, the occur and resolvement ofmedical resovlement depend on the participation and cooperation of many socialaspects. This paper introduced the overal background of the domestic medicaldisputes and through the literature, we analysed the causes and negative effects ofmedical disputes, and described the methods for medical disputes and thecorresponding limitations.In 2009, Tianjin become the first district which issued the《medical disputesolutions》in the name of provincial local government, and then the Tianjin MedicalDispute Mediation Committee and the Tianjin medical dispute claims center werefounded. On the base of long-term work experience, the actual conditions of themanagement of medical safety, the《medical dispute solutions》enacted in 2009, andthe two new founded departments for《medical dispute solutions》, we proposed themodel of three party cooperation. This three parties include medical institutions,insurance claims center, and the medical dispute mediation committee.In this article, we analysed the health related data and the medical dispute details between 2006 and 2008 in Tianjin, besides, investigated the cognition status ofmedical personnel for medical dispute through questionaire, and analysed the status ofmedical dispute in Tianjin before《medical dispute solutions》was enacted. On theanalysis of the effects of the three parties model on the medical industry, we foundthat the medical index increased steadily and gradually, but the incidence of medicaldispute decreased significantly. This model is effective and easy for extention, and itdeserves the emulation by other local governments. Promisingly, it could help toimprove the domestic medical service level, alleviate the tension of doctor-patientrelationship, diminish the incidence of medical dispute, and promote the harmony andstability of the society.
