Study The Legal System On Expropriation Of Houses On Stated-owned Land And Compensation

As a very significant part of modern city construction, the expropriation of houses on state-owned land and compensation has compact collection with citizens'daily life and production. In the past expropriation process for city houses, due to the shortcomings of the system itself and deficiency of the laws and regulations, the demolition contradictions are increasingly more and more fierce the various words such as"nail households","violence relocates"often showed on the newspaper, which reflects the seriousness of this problem. Our state council in 21 January 2011 officially promulgated the"Regulation on Expropriation of Houses on State-owned Land and Compensation"(the regulation or referred to as"Expropriation Regulation") after the state council formulates the draft version of the regulation for tow times. The release of this regulation means"Housing Demolition and Relocation Management Regulation"is completely disabused and it offsets the lack of the houses expropriation system. Based on the new regulation, the legal system on expropriation of the houses on state-owned land and compensation goes ahead a big step forward. But at the same time, it is undeniable that the housing expropriation and compensation legal system still has some immature defects which need further improvement and progress.This paper will use some analytic methods such as concept analysis, historical research, comparative research and integrating method of theory and practice, meanwhile combining with present legislation situation and execution situation from the aspect of the housing expropriation and compensation to analyze and discuss this legal system. This paper is divided into six parts. First, this paper will mainly discuss about the expropriation of houses on state-owned land. Second, this paper will discuss and analyze the great progress about"Regulation on Expropriation of Houses on State-owned Land and Compensation". Third, the paper will emphatically analyze the administrative legal relation with expropriation of houses on state-owned land. Then, the paper will analyze the advantages of foreign estate expropriation system and compare the foreign estate expropriation system with our country's. Finally, the paper will suggest some advises about how to improve and perfect the legal system on expropriation of houses on state-owned land and compensation.In short, we have responsibility to improve the legal system on expropriation of houses on state-owned land and compensation. In this paper, I seriously analyze and discuss this legal system and put forward my own opinions. Through this paper, I hope it will be helpful to contribute my limited power to perfect this legal system.
