Dilemmas And Countermeasures Of Patent Compulsory Licensing In The Internet Of Things

The Internet of Things is an enormous ubiquitous-network which is connecting the objects through various sensors and the networks. Merging and conversation between the information world and real physical world have been realized, which makes the usages of resources more intelligent, rapid and integrated. It also meets the needs for the efficiency of the social and economic development.This thesis describes the dilemma of the patent licensing in the process of integration and innovation of the Internet of Things. Meanwhile, the method of compulsory licensing has been proposes to solve such intellectual property rights problem.This thesis firstly analyses the developmental route and technical characteristics in the integration innovation of The Internet of Things at home and abroad, industry-crossing and high-density. On this basis, the paper analyses the plight of the patent licensing at present and some inevitable problems associated with the patent protection in the process of breaking compulsory license of the technology monopoly enterprises. Then it proposes the necessity of introducing the compulsory licensing system according to the characteristics of the patent license which is the multidisciplinary cross licensing.At last, it proposes to solve the balance of interests between the patent protection and compulsory licensing system by means of perfecting our patent compulsory licensing system and the patent protection market environment.
