With the rapid development of economy and increasing urbanization, domestic service as a rising industry, has become an indispensable part of urban life and an important field absorbing rural women and city laid-off workers to be employed. In such serious employment situation, the domestic service has played an significant part in the development of economy as well as society. However, it as a non-standard form of employment, has exposed many problems during its rapid development, due to the lack of integrate legal system. Especially, the nanny often suffers from a personal injury in the serving process, for which the reason is various, such as the responsibility from the employer, or the third party, or the nannies themselves, etc. Facing the different personal injury the nanny has suffered, whether should the employer be responsible? So for this, the paper based on the basic theories, combining with the real cases, is expected to clarify the responsibility the employ should assume and the extent to which the employer should compensate. By analyzing in the view of public place, basis of liability, liability principle which lie in employers, the paper aims at studying the issue of the employer's duty and compensation in the case of the nannies'personal injury.
