Enticing The Detection By Legal Control In China

Following the footstep of Reform and Opening, now the situation of criminaldevelopment in our country is demonstrated by making a spurt of progress, showing adiversity of features. Taking a sweeping view, enticing the detection of implicatedcurrent status, has already become an absolute necessary method of investigation, itexisted in a vacuum state without people's inspect, not only makes the enticingdetection metamorphosis into manufacturing instrument of crime, but also tramplesthe justice, so in theory and practice also instigated the new trend that are how tocontrol the boom, but mostly from one hand,to construct and complete enticement thedetection system, so it is urgently needed to lure detection system by comprehensiveand meticulous legal control.This article through four parts to attempt to propose some legal controlsuggestions. In the first part,the author firstly introduces the basic theory of enticingthe detection. This part was from the fundamental definition of enticing the detection,and strictly distinguishes the other promiscuous concept, then analyses its features,and defined the types of enticement detection system. In the second part, the authormade a comprehensive elaborate about the current situation of our country, and findout the problems.In the third part, after the author investigated advanced legislationand practical investigation of the Anglo-American and continental two legal enticingthe detection system, and carried on the summary and evaluation, to construct ourcountry's enticement detection system with enlightenment. The fourth part is theconstruction of China's enticement detection system, which is also the most importantpart, first theory principle as the basic foundation, hold the construction of enticing thedetection system totally, then the author attempts from legislative, judicial supervisionand law enforcement these three aspects to control enticing the detection system inlaw.
