Study Of Chinese Economic Consideration System

Our country is now in the new period of constructing harmonious socialist society.The rapid rise of divorce rate is an impressive social issue.So as to solve the new questions in divorce,the amended Marriage Law of 2001 adds many terms,to effectively protect the weak partner in the marriage.From the current situation, property management in divorce is still a major problem. The construction of Chinese Economic Consideration System is another breakthrough about property management in divorce after Economic Aid System.But there are still many controversial issues since the construction of Economic Compensation System.The deficiencies of the system itself greatly reduced its significance,so the legislative,the judiciary and the academic should carefully study this system in order to better improve it.The dissertation consists of three parts:instruction,text and conclusion. The instruction is about the reason of topic,the significence of study and the methods of research.The text is divided into four chapters.Chapter one introduces the content of Economic Consideration System,including legislative provision,concept, applicability conditions,and the nature and basis of Economic Compensation Claim; Chapter two demonstrates the necessisability of Economic Consideration System from theoretical and practical points of view;Chanpter three analyzes in detail the relates between Economic Consideration System and Community Property System, compare from the horizental the difference between Economic Consideration and Economic Aid System, Damage Compensation System, Maintenance Support System,Compensation System for Reasion of Divorce,Freedom of Action Fund System;Chapter four discusses the current situation of Chinese Economic Consideration System and its limitations.In the end,this dissertation puts forword several suggestions on the polishing of legislation basing on the analysis of defects of Economic Consideration System.
