Urban and rural areas under the planned economy led to separation of state and collective land rights is deeply divided and collective land even in urban construction, which lost some of their rights and become victims of urban construction.80 years since the 20th century, urbanization, rapid expansion of urban space, to ensure demand for land for urban development, a large number of agricultural land has been imposed, despite the accelerated urbanization process in China, but can not be ignored, the urban development consideration is the decline in living standards of farmers and the landless problem of unemployment increased, so that further antagonism between urban and rural areas.Party Plenum proposed a "new socialist countryside," the call, congress report further stressed "urban and rural development, building a new socialist countryside. Goal is the construction of new countryside, "the development of production, affluent life, civilization, clean and tidy villages and democratic management" in five areas, in order to achieve this goal we must first have a new rural construction plan, which involves rural land resources the use of problem, so this is not only for the efficient use of land resources in rural areas provided new opportunities and posed new challenges.However, at present, the rural collective construction land management is still in a state of non-standard, the law in the management of rural collective construction land does not play a relevant role. Law is the public administration, an important basis for public governance; law is an important means of a governance state.The law of the land resource management system is also the national legal system an important component of the system. Construction of new countryside in China is currently carrying out a vigorous, rural construction land use relates to the rational planning of the overall level of urbanization, rural construction land issue has been put on the agenda, although the relevant policies have been put forward, but the system of laws and regulations system not yet formed. Because of the lack of land management legislation, the legal basis supporting the theory, the existing management of the rural collective construction land system and legal system, lack of maneuverability, to the management of rural collective construction land had a negative impact. In this regard, the author from the perspective of a large land law, land for construction of rural problems in the legal system sort out the system, trying to make its legal system to make up the loopholes and gaps, to the basic theory of economic law as a starting point, for rural collective construction land management system, legal system.Rural collective construction land as a farmer's property to ensure that only the transfer of their property rights can be achieved.For transfer of collective construction land market, we must first establish the ownership of collective land for construction, through the registration system to establish the ownership of the authority vested in the State, may reduce the cost of land disputes. Second, in the protection of cultivated land, ensure that the premise of national food security, follow the country's land use planning, development of rural collective construction land use control system, in strengthening the overall planning of the use, while use of controlled release specific control measures promote collective construction land transfer. Finally, to achieve transfer of property rights to collective land for construction to inventory management as the focus of collective construction land management, relying on a system of linking urban and rural construction land change to improve efficiency in the use of collective construction land, the establishment of rural social security system and improve the lives of farmers and development capacity, a new socialist countryside.Meanwhile, with the social change and transformation, national economic development, urban expansion, rural urbanization, speeding up the process of urban and rural areas, rural collective construction land management into land management is currently the focus of attention. In the planned economy to a market economy in the process, the management of rural collective construction land to create urban and rural areas in urban and rural division based on the change from static to dynamic management of change management to inventory management as the focus of collective construction land management, increase and decrease with the urban and rural construction land construction land use system to improve efficiency as an important system, and promote the rural collective construction land use right, the co-ordination of urban and rural land.
