The Causality Of Environmental Crime

With the continued deterioration in the environment, dwindling resources, pollution case, People's attitution about environment has some chang. Many scholars began to focus on the study of environmental crime, they want to strike a balance between environmental and economic.In the environmental crime ,The causality is a very important problem. Because in the largely of the punishment of causation, which depend on the causality. But the environmental crime has some special nature, and it is difficult to identify the causality, so the causality is a popular question by the scholars. The author is also very interested in this issue, she want to play some role in this development.This text is divided into totally five chapters, and its abstract is as follows. The chapter 1 is introducetion, it briefly introduces the significance of the topic, the research methods and the crime of polluting the environment. The chapter 2 discusses the traditional therories of causation. The chapter 3 introduces the conflicts between the crime of pulluting environment and the traditional causality theories. In chapter 4,the article introduces the innowation of causality theories in foreign countries. These theories have epidemiology theory, the indirect counter-evidence theory, the constructive causation theory and so on. In chapter5, the author makes a conclusion that we may apply the constructive causation theory in the environmental crime and should be provided in the judicial interpretation.
