Watershed Ecological Compensation In China Legal System Research

Ecological environment is the material basis of human survival, it plays an important role in economic development, but affected by the concepts of "Environmental resources priceless" for a long time, in the process of economic development, people are free to grab the ecological resources, result in the environmental resources were abused and destroyed. Meanwhile, along with the development of human society and economy, the material requirements rising, and the basin appeared serious environmental problems, cause the service function of river basin ecological system deterioration even loss. In order to protect and maintain the river basin ecological environment in which ecological systems can fully play services, river basin ecological compensation system should be established, and clear its contents by legal means. River basin ecological compensation system can maintain the balance of the ecosystem by incentive ecological protector implement protection act and inhibition of ecological destruction, it not only can overcome the problem of supply shortages caused by "public goods" attribute of environmental services, internalization the external cost of environmental services, but also can solve the conflicts of interest, make sure various stakeholders realize win-win. In view of this, the thesis studied the theory of river basin ecological compensation and the practices of river basin ecological compensation, and analyzed the current legislative situation of river basin ecological compensation in China; finally put forward some suggestions to improve the legal system of river basin ecological compensation.The paper structure is as follows:Introductory section of this paper pointed out the background and significance, analyzed and summarized the current situation of river basin ecological compensation, and briefly introduced the main contents of this thesis.PartⅠ:Overview of river basin ecological compensation system. First, from the broad and narrow sense introduced the concept of river basin ecological compensation, and put forward the concept of river basin ecological compensation from the perspective of this paper; followed make a distinction between the concept of compensation and other related concepts; At last, analysis the theoretical basis of river basin ecological compensation.PartⅡ:The investigation of river basin ecological compensation of foreign. This section introduces the models and management system of river basin ecological compensation in foreign and proposed for our reference in this foundation.PartⅢ:The status of river basin ecological compensation system. This section mainly from state and local normative documents introduced the legislation of river basin ecological compensation, according to the implementation of river basin ecological compensation, analysis of the model of river basin ecological compensation in practice and puts forward the problems in practice.PartⅣ:Perfect the legal system of river basin ecological compensation. In this section, on the basis of legislative situation and problems, puts forward suggestions to improve the legal system of river basin ecological compensation.
