The Analysis On The Legal Effect Of Ship Manager's Operation Beyond The Business Scope

The severe competition of modern shipping industry make the shipowner recognized the importance of reducing cost and enhancing management profitability. Meanwhile,with the competition becoming more severe,it is also boost the reform in every field of shipping industry. With shipping industry developed rapidly in China,there are so many new ship owners appeared in the market.In China,ship managers are new participants in the shipping market.At present,most regulations of law relating to ship managers are contained in the administrative laws,the current laws keep silent on the legal status and civil liabilities of ship managers,both in legislation and ptactice.There are some issues in relation to ship managers'legal status and civil liabilities,which are necessary to be studied. This thesis is focused on the basic issues relating to ship managers,and the author tries to use the basic theories of Civil law and Contract Law of the People's Republic of China while referring to the regulations in foreign countries to study on the problems relating to the legal effect when ship manager's operation over the range of business scope.The author classifies the ship manager's operation beyond the range of business scope into different parts and analyses the different legal effect upon different type of operations type separately and makes the research on the civil liability of ship manager when its operation beyond-scope. The author hopes that the thesis will produce positive effect to the current domestic professional ship management business.
