The Report On The Protection Of Geographical Indication Of Yangcheng Silkworm Cocoon

After the WTO<Trade-related intellectual property agreement> takes geographical indication with copyright,patent and trademark such traditional intellectual property as its protection objects, geographical indication has become a hotspot in the research of intellectual property circles.The study of intellectual property in international has lasted for hundreds of years.Currently,there are four law modes to protect the intellectual property in international.Such as the trademark protection mode represented by America,ZhuanMenFa protection mode represented by France,Anti-unfair competition law protection mode represented by Japan and Business logo law protection mode represented by Germany.But the research in our country just started from the 1990s. And it exists three protection system including state administration of industry and commerce,State quality inspection administration and Department of agriculture.Because three different departments participate in the same project,and the interaction management inevitably causes power conflicts and disorder in practice.Geographical indication,a kind of commercial markers just like other intellectual properties,is a new way to develop socialist new countryside and to increase farmers'income.State quality inspection administration announced to the nation through the 192 notice in 2006 that YangCheng cocoon should be protected as the geographical indication products from December 22,2006 on.The main objective of this research is to identify the main problems of geographical indication protection about Yangcheng cocoon in practice and explore the complete countermeasures about protection of geographical indication of Yangcheng cocoon.The basic idea of this writing is:This paper will take the theory about geographical indications and the corresponding laws and regulations as the backgrounds, combine with the first-hand survey data and information of geographical indication protection of Yangcheng cocoon and analysis which is about the existing Problems of geographical indication protection of Yangcheng cocoon, and finally raise my suggestion to improve it.In addition to the introduction and conclusion, the essay is divided into four parts. The structure and contents as follows:The first part will introduce the concepts of geographical indications, the characteristics of it, and the protection system of geographical indications briefly.The second part will describe and analyze the investigation of the protection of GI products "Yangcheng cocoon", specifically including the investigation constitution, Yangcheng cocoons basic information, the survey results and analysis.The third part proposes some problems about geographical indication protection of Yangcheng cocoon thought analyzing, including legislation, government, business, tea growers, production, marketing and so on.The last part presents countermeasures to perfect corresponding systems which is concern on the geographical indication protection of Yangcheng cocoon.
