On The Subject Of The Unit Bribery

With the development of socialist market economy, the unit offering bribes are becoming a new crime. The unit offering bribes refers to a kind of bribery or rebate or handing fee to seek illegitimate interests.In recent years, the scholars of our country have had many studies on the unit offering bribes, especially on subject of crime.The present study starts with legislative history and focuses on subject of crime in current criminal law to analyze the focus in depth and to make the subject of crime clear.The study is divided into seven parts.Part one: This part analyzes the significance of studying subject of crime in current criminal law and the key points of the problem.Part two: This part introduces legislative history since the foundation of our country and briefly compares the judicial interpretation of legislation in different periods.Part three: This part mainly focuses on the definition and Constitutive requirements of the topic in the present study in an enumerative way. What's more, this part has done thorough research on the main scope and main structure of unit crime.Part four: In the light of crime characteristics of the crime, this part analyzes and researches the subjective factors related to unit will and the purpose to seek illegitimate interests.Part five: This part studies conviction transformation of the crime, taking historical backgrounds, practical considerations and future values into account.Part six: Combined with the criminal judicial practice, this part summarizes some disadvantages and defects in the current law and puts forward some thoughts suggestions on perfection of legislation. Part seven: This part summarizes the full study and gives some suggestions related to the criminal judicial practice and theoretical research. The aim is to solve some specific problems of the definition of subject of crime and to further perfect the theory and practice.
