To Perfect The Legal Liability Of Collective Contract In China

Although the system of collective contract as an important legal system to adjust collective labour relation has been carried out in China for many years, there are lots of problems existing,the prominent problem is that the rate of signing the collective contract is very high but the rate of performing the contract is very low. The writer think that the mian reason for this phenomenon is that China lacks relevant legal provisons for legal liability for the breach of collective contract in the system of Chinese collective contract.This article, starting from the basical concept of collective contract, uses the method of comparing and analysing to make certain analysis about the legal liability in the Chinese collective contract and offers some immature ideas for perfecting legal liability of Chinese collective contract. The text of this article comprised four parts:the first part mainly defines and distinguishes the collective contract and the system of collective contract, summing up the feature of legal liability of system of collective contract .The second part analyses the legal relation,the liability subject and the liability form exsiting in the system of collective contract .The third part mianly introduces the present national and local legislation conditions and the existing defect concerning the legal liability of Chinese collecitve contract .The forth part offers some thinking to perfect legal liability about the problems existing in the legislation of legal liability of Chinese collective contract.
