The right to social security is those rights that shall be asked to offer under laws when people's income cannot maintain necessary living levels or normal living standard like old age, illness, disability, unemployment, death and so on. The right to social security is not only an important and basic human right confirmed and guaranteed by some documents of international laws, but also a basic constitutional right regulated by most Constitutions including the Constitution of China. For the state, state departments shoulder the obligation of taking measures to protect the right to social security. Because of the specificity of the senior citizens, the right to social security is more important for them than other persons. But in fact, their right to social security has not been paid more attention by the state. There are many reasons, but the most important reason is the lacking of constitutional protection. The constitutional protection of senior citizens' right to social security has the unique value and special necessity in our country. The constitutional protection of senior citizens' right to social security are contented by four aspects: the improving of our current constitution, the legislation guarantee,the administrative guarantee and the judicial remedy.
