Fraud is a crime against property of a specific offense, in the high incidence of social life. At present, the judicial determination in a lot of confusion exists, therefore, the crime of fraud is particularly important.In this paper, through the elements of the crime of fraud analysis, combined with case analysis approach to reveal the fraud of crime, fraud and other crimes to be distinguished. Purpose of this study is through this practical approach to the analysis of judicial practice, the difficulties identified on fraud. Legislation for the crime of fraud has become the consensus of scholars, so as to keep pace so that legislation, with a sound legal to promote the healthy development of the economy.
