On The Crimes Committed By The Arrest Of Institutional Reforms

In the past,official crimes of investigation and arrest and prosecution are in charge of a same procuratorial organs ,although procuratorial organs have restraint and internal division,but lack of internal supervision effectiveness. Many procuratorial organs arrest and investigate is in charge of a prosecutor and internal restriction is very weak. Some of the major case of Investigation and arrested is decided by the procurator-general of the same or procuratorial committee to discuss and decide, make the investigation of the relationship between supervision loses balance. For many years, scholars has been criticized this situation,many scholars suggest the right of at the procuratorial organshould be gived to court or cancel the procuratorial organs of investigation about official crimes. In the the situation of right of approved arrest not to give to court,and for to remain the right of investigation official crimes of the procuratorial organs,in 2009 September 1st executes reform about official crime of approed arrest system .Any a judicial system reform,in the process of implementing will exist many problems,should promptly put forward countermeasures to reform and perfect it. Therefore,the author did a lot of work about the reform of investigation and point the existing problems and the countermeasures should be taken,and puts forward some improvement Suggestions.
