| The author finds out that the cases of medical treatment accidents are taking big proportion in the civil cases during the long term agent cases. When the division and disagreement occur between hospitals and patients, the both parts used to resort to law as the best solution. China issued many regulations and policies as bellow:1987《the approach of medical treatment accidents》,2002《the regulation of medical treatment accidents》,2009《the infringement liability law》These law and regulations take the critical role in deal with the medical treatment accidents.The thesis is divided into four parts:Part 1: The analysis on the law usage of medical treatment accident.Part 2: The study in the regulations of the technical identification of medical treatment accidents.Part 3: Demonstrate the distribution between the compensation of medical treatment accidents and proof responsibilities.Part 4: The development and practical explore of the compensation of medical treatment accidents. |
