On Offer

The offer is the necessary phase of ording contract, and is also the basic content of the foundation of the contract.But the offer exists when our country formulates the Contract Law.Compared with the law system of mainland and the British and American, we started fairly late. Although the current Contract Law standardizes the offer by legislating, its provisions are too nebulous to settle the amount of contractual dispute. Therefore, the study of offer has its practical significance.This article begins with the nature of offer. It introduces the theory of the offer and the author's opinion. On the basis of the requirements of every country to the form of the offer, it summarizes the elements of the offer on each. Then it states the offer and the relevant questions of invitation to offer, including the basic theory, the analysis of offer and invitation to offer,and the legal effect. In the end, the article puts forward some proposals to improve the deficienciese of the offer existence of the Contract Law.
