Factual Errors Study

Error of fact has been the subject of concern and attention criminal law theory, but wrong about the facts related to issues such as definition, classification, and treatment principles but there is considerable controversy. Coupled with the lack of a clear Criminal Law provisions, resulting in the field of judicial practice, different standards apply to the situation. Foreign theory of criminal law by comparing the facts of the theory of errors, a more detailed analysis of various theories and of the content. On this basis, proposed a narrow concept and classification of factual errors, and argues that by the logic should be consistent with the statutory mistake of fact as a basic principle of treatment in order to help the work of the judicial practice.
