Administrative Reconsideration Committee Model Construction Research

Under the new situation of accelerating the government of rule of law and building socialist harmonious society, China is actively exploring new construction of administrative review mode which places the administrative review council as the core. Administrative review is an important system of administrative law which is generally established by modern states. The academic and practical realms of China are actively exploring the methods to improve administrative review institution as well as to exert the advantages of administrative review currently. Whereas, the understanding of administrative review council institution is not profound enough, neither are the theoretical research and scientific mode design. Therefore, constructing scientific and perfect theoretical and institutional systems of administrative review council holds significant value to the normal development of administrative review system of China. This study analyzes the situation and existing problems of administrative review institution in China as well as demonstrates the theoretical, institutional and realistic basis in constructing the mode of administrative review council. Further, this study emphasizes the combination of theory and practice to discuss the issues of relevant law principle, functional positioning and the convergence of relevant institutions. Besides, the author makes recommendations about the organizational form and operational mechanism of administrative review council construction, in order to make some contribution to the improvement of administrative review institution of China.
