Ever since the mortgage system was introduced from Hong Kong in the early 1990's, the mortgage of marketable housing of China has experienced over 20 years local development to gradually develop its inherent operation mode with Chinese characteristics. With the revolution of the commercial building, as being a financing guarantee of housing, in recent years, in the recent years, the mortgage loans have been booming year after year, it has further demonstrated its formidable vitality. However, being a new thing in our country, house loan policy's change each time, can bring the giant mighty waves to the entire market. As one new way, about mortgage on commercial estate' essence, we haven't been established identity between theory and practice. Being short of relevant legislative regulations, mortgage on commercial estate brings about chaos in practice. Study of mortgage risk preventive and evadible measures and conceptual thought of consummation of mortgage of future marketable housing of China, all of these are of academic value and practical meaning. This thesis takes the mortgage of marketable housing as the research object and adopts the comparative method to analyze the topic from both theory and practice angle. Through the analysis of the conception and evolution of the mortgage system, the characteristics and legal relationships of the mortgage of marketable housing, and subject matter of mortgage of marketable housing and the preventive measures, its hopes to explain the mortgage of marketable housing and provide suggestions for the practice.
