Research On Crime To Organize The Minors Into Violating Security Management Activities

The growing of minors affect the future of a country, however, in recent years, some minors were organized to conduct theft and snatch in some cities, there usually have one or several adults is manipulating on their back. This behavior has serious infractions to social public order and minors'mind and health. But because of the rules of law are too broad, we can not confident this newly arisen crime phenomenon easily in practice, we can not punish this phenomenon powerfully, so the effect is not well.<Criminal Law Amendment (seven)> had been passed in 2009, there is specific rule aim at this problem in the amendment. In order to comprehend the original intent of legislation deeply and apply it into practice, it is necessary to research the crime comprehensively, and analyze the problems that maybe appear in the judicial practice. We hope to that will have benefit to the legislation and judicial practice in the future.The paper is divided into three parts to analyze the crime that Crime to Organize the Minors into Violating Security Management Activities.The foundation of legislation is the focal point in the first part:First, author expounds the phenomenon that some people organize the minors into violating security management activities, and generalize the particularities. Secondly, author analyzes the criminal basis of the organizational behavior in three sections:â… . By the way of expounding and generalizing the law rules that protect the minors, we could understand the system of protect minors deeply.â…¡. We could get the reasons that the criminal law set the organizational behavior into the crime by analyzing the society theory and actuality.â…¢. By the way of analyzing the criminal policy basically, get the effect when the criminal law increases the crime.The second part, the focus of the paper, analyzes the difficult problems of constitution of crime of crime to organize the minors into violating security management activities mainly. The author researches constitution of crime on four sections, according to traditional criminal theory, the constitution of crime include subject of crime, subjective aspect of crime, criminal object, objective aspect of crime. It could solve the difficult problems by the way of analyzing the requisites of each constitution of crime, thus, we could understand the constitution of crime that has been analyzed in this paper comprehensively.The phenomenon relative with the crime that might appear in the judicial practice is the focus in the third part, and the situation that how to convict is more important in it. We should conduct specific analysis on concrete issue. The author does the analysis on three sections including crime & innocence, diffident crimes and the special form of the crime. Research the different situations might appear in the judicial practice as much as possible, thus, we could acquire the scientific and guiding conclusion about the crime.
