Research On The Legal Problem Of The Quality And Safety Of Agricultural Products

China is a populous developing country which is mainly based on agriculture .And agriculture is the economic lifelines of our country. The problem of the quality and safety of agricultural products have a direct impact on our 1,300 million people's health and safety, the protection of the agricultural products'quality and safety is the important premise of the national economy maintained good growth. With China accessioning to the World Trade Organization (WTO) and the globalization of economic and international trade developing rapidly, the international trade of agricultural products has increased frequently. The problem of the quality and safety of agricultural products has not been merely a nation's problem, but related to the whole world social and economic issues.In recent years, the quality and safety of agricultural products incidents have frequently occurred, which draws the whole society'attention. For example, in China"Sudan red" incident in 2005, "the noxious rice" incident in 2008 and"SanLu Milk " incident in 2009 and so on. These incidents tolled the alarm bell to the quality and safety of agricultural products departments. And many foreign countries also have very serious problems for agricultural products of quality and safety, such as the mad cow disease raged through the united kingdom in 1996; the porcine spongiform encephalopathy, pse in the southeast Asian countries in 1998; and 1999 Belgian dioxin chicken pollution affair, foot and mouth disease and bird flu; In 2008, the food contamination of listeria monocytogenes affair in Canada makes 20 people die. These series of major agricultural products'quality and safety accidents caused economic loses and social panic. These make the problem of agricultural products'quality and safety more and more stand out of its severity and urgency.At present, China has promulgated"law of produce quality safety","Foodstuff Sanitization Law"and"Product-Quality Law"and many other laws and related regulations. The security system, the supervisory ability, the agriculture standardization and related law and relations all have improved some. But comparing with many developed countries, China has done so far from enough.This thesis has five parts. It starts from the present problem of agricultural products'quality and safety; analyze the present law and relations of agricultural products'quality and safety and its problems which based on the comparison with the developed countries; then give some advices to reforming and improving the quality and safety of agricultural produces.The first part states the related conception about the quality and safety of agricultural produces. Including the definition and range of agricultural products and definite to the primary processing agricultural products, genetically modified agricultural products, agricultural products'quality and safety, the problem of agricultural products'quality and safety.The second part states the present situation of agricultural products'quality and safety, raises its main problem and analysis its causes.The third part states the law and relations of agricultural products'quality and safety of the foreign countries and the revelation. By analyzing the developed countries'legislation and supervision system, finding out the revelation to our country.The fourth part states the situation and problems of our legal system for agricultural products'quality and safety. This part includes the current legislation and supervision system in our country and points out the problem of it.The fifth part gives some advises about the problem of agricultural products'quality and safety. To solve these problems, this paper presents countermeasures from perfecting the law system, regulating the supervisory authority, perfecting supervisory system and the system of legal responsibility.
