The Legal Studies For Compensation Policy Of Glasslands Ecological Benefit In Northwest Of China

Natural grassland in northwest of China, as an important constituent of ecological system, has lots of ecological functions such as water conservation, soil and water conservation, wind prevention and sand-fixation, atmosphere adjustment and biodiversity maintaining. However, our ecological safety faces threats from different degree of degradation over the 90% grassland, natural disasters and declining grassland ecological service function, due to human excessive reclamation overcharging dig, over-grazing, furthermore occurrence of rodents and pests. Ecological compensation is a new method for ecological environment effective protection and management, which comes up recently, and an important subject for the scholars focuses on. Relative other Country speaking, ecological compensation in China is less backward in the theory and practice, especially the theoretical study of grassland ecological compensation is in the initial stage, besides the practice is also in the exploring stage.This article, draws lessons from research achievement of ecological compensation and grassland ecological service value at home and abroad, and the research based on ecosystem value theory, public goods theory, externality theory and rights and obligations reciprocal theory, which is build the frame of grassland ecological compensation mechanism, and make sure of fundamental question that the basic framework of grassland ecological compensation are compensation subject, compensation object and compensation standards. On this basis, this paper takes the northwest natural grassland for example, and analyzes the basic situation of ecological protection and construction in northwest natural grassland and the problem in this process, makes sure about the compensation subject, compensation objects, compensation standard from the angle of ecological service providers and beneficiaries, at the same time, give the advice for perfect relevant laws and regulations based on analysis of some measures of our Country, which is better for grassland ecological compensation to be legal guarantee for carrying out grassland ecological compensation smoothly...
