Comparative negligence is a very important principle, which ascertains the range of damage compensation. It means that if a victim is also at fault for causing the damage, the civil liability of the infringe may be reduced. In a sense, the reality was that the neligence of the third party is considered the victim', his own negligence imputed to the victim who beared the final liability .So comparative negligence can 't be considered only the victim ',but also include the identity or in life must be regarded as one of the third person's fault. We call it imputed contributory negligence.However, which one is the third party and why the third party ' negligence should be imputed to the victim.How to apply it ?
