Research On The Connection Between Security Case And Criminal Case

As the executive branch, the police can implement both the administrative law and criminal law. This duel function is mainly carried out through dealing with public security offences and criminal offences, which, in the judicial practice, are sometimes overlapped and convertible to each other. This paper elaborates the underlying reason for such overlap by analyzing the relevant laws and regulations, the judicial practice as well as individual factors; and expounds the relationship between public security offences and administrative offences. As the State organs for legal supervision, the People's Procuratorates should supervise the overlap between the public security offences and criminal offences. Nevertheless, due to various reasons, such supervision is not fully enforced at the moment. This paper presents several suggestions in this regard, in expectation of enhancing such supervision by the People's Procuratorates.
