Employ contracts and work contracts are two common contracts which are widely applied to practice. While it is difficult to distinguish them clearly only based on social experience and preliminary anglicises, because there are some ambiguous contents in the scope and standard of application . Analyzing the same contract in different aspects, different results will come out. Therefore, the two parties'responsibility of the contract are hard to be identified, bringing unconvinced to the judicial practice. Through the comprehensive comparison and concrete analysis of specific cases in the upper two contracts, this dissertation will differentiate the employ contract and the work contract generally and identify the assumption of the tortuous obligation of the both sides. |
