After China's accession to the WTO, subject to tariff falling sharply, the appreciation of the Renminbi and other factors, trademark parallel imports has been an important issues facing China. However, our related experts and researchers have not yet reached a common understanding on trademark parallel imports. No relevant trademarks parallel import legislation lead our justice trouble. Therefore, the legislation is imperative, and it is the intention that the paper is trying to study. In view of the fact that International Convention on the parallel import of trademarks do not make explicit provision Act, but rather by the countries themselves, according to relevant basic theory and literature, this article using the methods of analogy, deduction, inductive inference study and analyze the theory and practice of parallel imports in the United States, European Union, Japan which are the most representative ones in related issues. Combined with realistic conditions that China remains as a developing country and also more dependent on foreign in the intellectual property rights, the suggestion is that China should enact trademark parallel import , and take the "principle allows, but there are exceptions" attitude. This article is filled with three parts including an introduction, body and conclusion, and the full text is about 33000 words.
