Study On Credit Assignment

From the prohibition in the era of planned economy to its establishment by Contract Law after our country's establishing market economy system, credit assignment hasn't been existing long in our country compared with that in western countries and its system still remains to be perfected. And as an intangible form of property, creditor's right has become an important factor of production. The credit assignment system makes it fluently for property to circulate, which enhances the transaction efficiency and promotes the increasing of wealth and as a highly-efficient legal system, credit-assignment system has become more and more important in the legal system of market economy. This article has introduced the developing history, characteristics and functions of credit assignment, and analyzed the qualification of assignor and assignee, the effective factors of assignment, legal effect of assignment notice and legal effects after the assignment. And based on the practice of credit assignment and the analysis of its faults, this article has put forward several suggestions on perfecting the credit assignment system by exploring the ways to balance and protect the interests of the assignor, the assignee and the obligor, the methods to establish a better notice system of credit assignment, the approaches to restructuring the credit-assignment range.
