The Sentencing Right To Make Recommendations For Research

Sentencing reform is the focal project in China's judicial reform in recent years. Based on this background, the prosecution has been implementing sentencing recommendation system actively. With a few years of exploring the theory and practice, sentencing recommendation system has been showing vigor and vitality. The Supreme People's Procuratorate issued the'Guidance on the People's Procuratorate Carrying out the Work of Sentencing Recommendation (Trial)'in 2010, which promoted sentencing recommendation work and pointed out the direction for the grass-roots procuratorates. In this paper, firstly, it makes a definition on the concept and charactor of sentencing recommendation right. Secondly, it expounds the legal spirit of sentencing recommendation right. Thirdly, it investigates and studys the foreign sentencing recommendation right. Fourthly, it emphasizes the significance of sentencing recommendation. Finally, it explores some problems on sentencing recommendation system in the judical practice and puts forward her own ideas.
