July 1, 2010 came into effect two rules of evidence, that " Regulations on the Exclusion of Illegally Obtained Evidence in Criminal Cases Enacted " and " Regulations on Reviewing and Determining the Evidence in Death Penalty Cases ",which clearly provides the issue on ivestigating officer to testify in court. However, the phenomenon that investigating officers still do not testify in court is very common. Investigating officer refuse to testify in court,which is not conducive to find out details of a case and to constraints illegal investigative behavior. We should change our thinking and ideas, enhance the legislative level, improve the existing law, clear the identity of ivestigating officer to testify in court, expand the start subject of ivestigating officer to testify in court, to expand the scope of ivestigating officer to testify in court, provide the legal responsibility of perjury, improve the security system to improve system of investigating officer to testify in court.
