The Research Of The Penalty Of Bribery

The bribery crime has been always the focus of the fight of anti-corruption because of the highest rate in the official corruption in China。Many new problems appeared on the traditionally theory and the practice of bribery crime along with the rapid development and the transformation of our society,especially on the theory of bribery penalty。Based on the study on current bribery penalty,here in this thesis i discussed and analyzed the problems existing in aspects of the amount of bribes,the kinds of bribery penalty and grade of bribery penalty by the theory and the practice;to demonstrate the necessity of improving the bribery penalty;and finally,based on the study about bribery penalty by experts of China,and together with the advanced practice in abroad,I proposed to improve the bribery penalty by improving the kinds of penalty,the grade of penalty,the standard of the crime and abolish the death penalty in order to achieve the purpose of punishment and maximize the benefits.
