Legal Research On Xinjiang Labor Dispatch

As the unbalanced development of regional economy in China, the development of the labor market shows a significant difference across our country. For this reason, the situation of the labor dispatch appears complex. Relative to the coastal areas, which are economically developed areas, regional differences of labor dispatch is more noticeable in Xinjiang. After the Xinjiang Symposium was held in Beijing, the labor dispatch became a new mode of employment. And with the rapid economic and social development of Xinjiang, it spread to almost all industries. As one of effective ways to adjusting resource and promoting employment, the labor dispatch became an important tool to disposing the labor market in Xinjiang. At present, the labor dispatch of Xinjiang is on the stage of rapid development. But in the recent practice of the labor dispatch of Xinjiang, we not only found universal problems, but also found special problems..Although we have "law on employment contracts" and its implementing regulations, and the government of Xinjiang Uyghur autonomous region also legislates three regulations:"Interim Measures of Xinjiang Uyghur autonomous region on labor dispatching organizations to develop and actively promote labor export (in) ", "regulations of Xinjiang Uyghur autonomous Region to promote the development of labor dispatching organizations ","interim administrative measure of Xinjiang Uyghur autonomous region for qualification of labor dispatch", but, these regulations haven't adequately consider the certain limitations of labor dispatch and the special circumstances of actual operation. Therefore, based on the actual situation of domestic law in our country and the actual situation of the labor dispatch in Xinjiang, this article try to analysis the problems in those two aspect, and also attempt to make some personal recommendations on how to improve the legal system of labor dispatch in Xinjiang.
