Defective Auto Product Recall Study Of The Legal System

At present, the car has changed from the luxury consumer good into the ordinary consumer good. More and more families have their own cars. By the end of2009, China has overtook Japan to become the world's largest producer of automobiles, and even replaced the United States to become the world's largest automobile market. However, at the same time, more and more recall events of defective automobile products appear. In2004, China's first department regulation of recall of blemish car product" defective automobile product recall management regulations" was promulgated, but the community debates about this regulations in many aspects. Therefore, after a revision," automobile products recall supervision and management regulations" draft was published. To further improve China's defective automobile product recall law system.This paper consists of four chapters. The first chapter summarizes the defective product recall system, and introduces related concepts of the system, and analyzes the law relation of defective automobile product recall law system; then it further elaborates the recall modalities and procedures of defective automobile product recall law system, and finally points out the significance of the implementation of this system. The second chapter introduces the Japan national defective automobile product recall law system; it summarizes the advantages of foreign related system through comparison, and hopes to provide useful reference for our country to improve the defective automobile product recall law system. The third chapter comprehensively introduces" defective automobile product recall management regulations", the draft of" automobile products recall supervision and management regulations"," tort liability law of PRC" and other related content. The fourth chapter puts forward the suggestions of improving our countries' defective vehicle product recall law system, includeing the improvement of legislative, strengthening supervision, attention to consumer rights, learning from foreign advanced experience, unified legislation and so on.
