Being an initiation and practice of new system, Criminal reconciliation has not yet been formulated as the law. However, with the gradual deepening of the idea of building a harmonious society, criminal reconciliation is developing a focus in the academic and practice areas in recent years. At the same time, as a practice of reform attempt, after its creation, it has been widely concerned. However, in the process of the formation and development of criminal reconciliation, the criminal reconciliation system caused various argues, and in the judicial practice, the actual condition of different district are not in the same. Based on this, we must reconsider the system in the condition under the Chinese context,and put forward the tentative idea of criminal reconciliation. The purpose of this paper lies to systematically arrange the theoretical basis of the system and judicial practice through researching the domestic and foreign relevant criminal reconciliation system, as well as investigating the local criminal reconciliation practice. Therefore, the author studies broadly relevant literature, especially the domestic and foreign related system; through the practice investigation and analysis of the domestic, analyzes and evaluate the actual effect of the criminal reconciliation; rationality analyzes this legal system with the comparison of different domestic judicial pattern. The thesis is divided into six parts:the connotation of criminal reconciliation; the rationality and feasibility of the system; Chinese traditional law with criminal reconciliation nature, as well as the criminal reconciliation system abroad; the effect of the criminal reconciliation agreement; construction to perfect the criminal reconciliation system.
