Research On The Issues Of Social Injustice Phenomenon Caused By Duty Crimes And Countermeasure

Duty crime is a malignant tumor of China's socialist modernization, endangering people's normal social life and public order, and contributing to social inequities. With the continuous enhancement of the national anti-corruption efforts, attention and study of the people for crime committed more and more deeply, so how to effectively prevent and control crime committed is not only a theoretical academic focus, but also the judicial practice need to focus on research topics.The social injustice which leads by duty crime is the result of multiple factors, which can not be separated from the greed of the people, the deficiencies in the system, as well as regulatory fatigue. Therefore it is necessary to have multi-dimensional prevention and management for duty crime. This paper uses case analysis, document analysis, lessons learned the method, system and scientific method and other methods, and integrates theory with practical from a legal point of view, the economics, political science, psychology, management and other multi-disciplinary knowledge, it trying to lead to the phenomenon of social injustice through the analysis of job-related crimes to explore the relationship of job-related crime and social equity, and find further comprehensive preventive measures to control duty crimes First, it proposed the intrinsic relationship between these two inseparable core point of job-related crimes and social equity and revealed the hazards and negative impact of the crimes committed on social equity and clarity of job-related crime lead to the inevitability of social injustice. Second, the article fully drew on the evaluation criteria of social justice at home and abroad and grouped our society into four categories, namely, equal opportunities, rights and fair rules of fairness and distributive justice. Then it combined with the specific duty crimes typical cases and explained the job criminal behavior of these four kinds of social equity caused against. Theory with practice through four real cases and in-depth analysis of duty crimes of the adverse impact of social injustice and harm, and duty crime lead to social injustice related mechanism not only deepen the awareness and understanding of the theory of job-related crime, but also closely linked to the social phenomenon, contact the people to pay close attention to the issue of social equity. It has important theoretical and practical significance to job-related crime and social equity in-depth study. The article finally analyzed the various measures of governance duty crime lead to social injustice. Governance of the crimes committed is not easy, and it involves all aspects of interest. So we must to break one by one from the various stages of the crime committed mainly engaged in the first prevention a matter of governance and the subsequent supervision of the three aspects of the anatomy of the system, respectively, from the perspective of legislation, education, finance, supervision and punishment. We can achieve the purpose of successful governance of duty crimes and safeguard social equity by various ways.
