Climate change is a typical global problem,for the particularity of climate and environment, its influence has broke the national borders and the districts,influence the survival and development of all mankind.For the global warming has become an irreversible objective reality, in order to prevent it continue to deteriorate, Countries has concluded<The United Nations Framework Convention on Climate Change>,<Kyoto Protocol>,<Copenhagen Accord>,work together to curb the global warming trend."Have no proper environmental law mechanism,any environmental policy tools are difficult to have the effect on the environment, economic efficiency".In today's situation, this has become a global consensus of all the world. To strengthen the construction of environmental laws and regulations, improve the environmental law practice in operation, is the main aim of the world's Environmental law construction.The history and reality cause the ecological environment in China is more fragile, more vulnerable to the adverse effects of climate change.At the same time,our country has the mission of modernization construction and economic development.Facing Climate Change,we bear more severe challenges more than any other countries.The best way to deal with problem only is more active, to perfect Environment laws and policies.Drive and improve the circular economy development with the law system.Throughout Chinese environmental law system,we find that our environmental legal system started relatively late, in the institution,supervision,or experience and many ways there are a lot of disparity between the developed countries.At present,our environment legal framework including22laws, more than40department regulations, about500standard and more than more than600normalizative document of laws of solving the pollution control problem, Natural resources protection and consumption goods environmental management problem.Laws and regulations have the same problem is low level and poor practice. It has become the main legal obstacle to improve our environmental laws and regulations in our country.Chinese Environmental Law has entered a critical period, with global warming trend growth, to perfect our Environmental Laws and regulations,improve the environmental law practice in operation has become a top priority.The western scholars attention on climate change early, research levels deep, involve and more widely. At present,our country academics study the issue is not very well,in response to climate change is still not enough legal mechanism of perfect and fully.This paper based on the comb on climate change of the international convention and the the experience of advanced western developed countries, in our own situation, make a systematically analyzed to perfect our country's environmental law in legal mechanism to cope with climate change.
