The Legal System Of Rural Collective Land Acquisition Compensation

The accelerated process of industrialization and urbanization have greatly increased the demand for land. But now the situation of the urban stock land is deficient, So it is inevitable that agricultural land be levied to satisfy the needs for economical and social development. However, there are numerous problems for our collective land expropriation compensation system:the standard and mode for land expropriation is not quite reasonable; the administrative and judicial means of dispute resolution are inadequate. And it induces a great number of land disputes. Moreover, it has caused a series of social problems:a lot of loss of arable land, illegal land acquisition, rights of landless farmers have been seriously violated. These issues make the compensation system of rural collective land acquisition has become a hot state and society of great concern, has become the focus of the Land Administration Law Amendment. The arrangement of current law and legislation of China is complicated, disordered, irrational and poor operated. Considering our current condition in the procedure of levying agricultural land, there is some theoretical value and practical significance to some extent for us to proceed in a further and systematical research.This paper uses the methods of system elaboration and comparative analysis, taking the present compensation system of agricultural collective land expropriation as the researching objection and based on the basic theory of the collective land expropriation compensation mechanism and the experience from other countries, this thesis points out the defects of our current land expropriation compensation, explores its reason and puts forward the legal strategies to reform and perfect our land expropriation compensation, designed to provide a useful reference for the effective solution to the problems of China's rural collective land acquisition compensation.
