Asset Securitization Risk Prevention Research Legal Issues

Asset securitization is the greatest financial innovation the20th century, meanwhile it is an important incentive result for the global financial crisis in2008. Though asset securitization has the inescapable responsibility for the financial crisis,it shouldn't be denied for its positive aspects. We should deal with the various risks by establishing the more improved operation system of asset securitization and taking many-sided risk regulatory mechanism, in order to play the unique advantage of asset securitization in the case of effective risk prevention.The first chapter starts from the basic connotation of asset securitization, detailed introduce its concept,legal relations and operational processes, leads to all kinds of risks that may exist in the process of asset securitization;The second chapter describes the development of asset securitization in China respectively from the aspect of system construction and regulatory regime, and totally analyzes the legal issues in risk prevention from the aspect of securitization and regulatory level; The third chapter compares the international development of asset securitization, introduce some relative mature system abroad such as the operation and bankruptcy in order to have implications for risk prevention of asset securitization; The fourth chapter proposes the perfect proposal of asset securitization risk prevention from the level of system operation and regulatory regime on the basis of advanced experience of foreign countries.
