The most practical consequence is that farmers have no right to dispose of their land and property, there is no ability to protect their legitimate land property, but can not afford to make their land assets to enter the market flow to obtain the value-added.Present unreasonable land requisition system wantonly misappropriation of farmers'interests. With the accelerating process of industrialization and urbanization, inevitably imposed a large number of rural collective land. In the process of land expropriation, farmers and land to be levied for a clean break with part of the property rights have been deprived of interests vulnerable to damage, leading to increased year by year the number of landless peasants.The transfer of land with non-standard behavior. Government artificially rural land circulation and composition deviates from the actual process of the initial transfer of rural land resulting in the transfer of rural land policy objectives; land contracting right and obvious administrative enforcement color and which few people use the land transfer to "find rent "open the door, twisted the rural land market, but also seriously damage the interests of the farmers'land.The use of land property rights theory, market failure theory and property rights dual structure theory, through the survey method, to study the contrast method, theory with practice methods, the main line to the transfer of rural land contract management right, based on the condition of our country, perspective of land contract management rights transfer system changes, reveals that the land contract management rights transfer system changes the law, clearly the current system changes of rural land contract management right path selection; micro and macro level, the current constraints of China's land transfer comb, analysis of the barriers that affect the land transfer, repositioning of the land contract and management rights transfer market players. On the basis of the above theory to give farmers stability and integrity of the land property rights; strengthen the market to guide, regulate the operation of the market; accelerate the building of the legal system, provide an institutional guarantee; improve the land supply and demand mechanism to promote the land transfer; to establish and perfect the social security system in rural areas; change government functions, and strengthen supervision and management, and policy recommendations. Provides a new perspective, and pointed out the direction and path specification for government action in practice, in theory, to promote rural land circulation.
