The Legislation And Perfection Of Laws Against Drunk Driving

Drunk driving issue has become an urgent problem which requires immediately solution. In recent years, the terrible injuries of frequently occurred car accidents aroused public concern. In the meanwhile, how to reduce the incidence of drunk driving and how to solve this problem trigger discussions in the academic circles. With the approval and implementation of the eighth amendment of criminal law in2011, drunk driving was seen as a crime and has legal support in China for the first time. According to the law, as long as drunk driving behavior happened, no matter whether there are facts of damage, he or she will punished with criminal penalty. This provision makes up for the deficiencies and blanks of the punishment of drunk driving before, and improves the provisions of motor vehicle drunk driving in our country. However, it is a new legal provision that many aspects of it are not perfect or meticulous, so that some problems can still not get detailed solutions. Through the introduction of the concept formation of drunk driving and relevant legislations, this paper aims to give rise to the significance of add the drunk driving behavior into the criminal law. Meanwhile, uses the foreign legislation on drunken driving for reference, points out that the legislation on the drunken driving in our country still has problems and defects now. Furthermore, the author puts forward to some appropriate suggestions based on the basic national conditions in China and hopes it will be conductive to the improvement of this legislation.
