The Qualitative Analysis Of "Stealing From Thieves"

With the development of the economy and the society, the existence of "Stealing from Thieves" is not uncommon, which has shown an upward trend."Stealing from Thieves" behavior is not clearly defined yet in the existing laws of our country. But in the real life and judicial practice, this behavior should be sanctioned by law according to the plot and the spirit of the law. At present."Stealing from Thieves" in China is still in the initial stage, there are only a few scholarly-works related to the phenomenon. However, there are a lot of "Stealing from Thieves" in our country, and there is a growing trend for this phenomenon. So the phenomenon is in urgent need of legal regulation from the academics. This thesis uses the definition of "Stealing from Thieves" as the starting point, and analyzes the common types of "Stealing from Thieves" and the application of the laws, to explore the present situation of legislation and judicial practice about "Stealing from Thieves". Based on these analyses, the thesis makes some recommendations to solve the legal issues exist in'"Stealing from Thieves". I hope that through the study of legal theory and judicial practice to explore the issue.
