The Improvement Of Minor Guardianship System In China

Minor guardianship system is a component of the civil system of great importance withthe aim to protect the interests of the minors, which shows the new tendency namedintegration of private law as the society develops. The system in China lags behind much,which needs to be improved urgently. This paper investigates relevant theories of minorguardianship system and integration of private law, clarifies the meaning and the specificrepresentations of integration of private law in minor guardianship system and analyses thespecific system of integration of private law in minor guardianship system in continental lawsystem and Anglo-American law system. With foreign advanced systems and the social basisand existing problems of China, this paper tries to find the way of integration of private law inminor guardianship system in China and proposes specific measures that are the updating oflegal concept, the establishment of the principle and the conceit specific system of minorguardianship system in China.
