The Study On Labor Contract In International Professional Soccer

Economic globalization has also brought the globalization of professional football, international soccer exchange continue to strengthen the international transfer more and more. In the process of transfer, the dispute on labor contract between the professional football players and the club also increase. Therefore, research the international soccer transfer system and study the labor contract between the professional football players and the clubs to help us better understand the development of modern football track and learn from the foreign experience, combined with the actual of our country to develop the professional football, and establishing our Contract dispute resolution mechanisms.This article is divided into five parts, the first part focuses on the development of international football and the status of professional football, the legal regulation of professional football and the importance and significance of professional football labor contract; the second part describes the nature of the international players as well as the transfer system, including the transfer system and the transfer fee, so that we know about the transfer of foreign development process; the third part is the most important of the article, as part of the study of professional football labor contracts, mainly on the definition of the labor contract, the main provisions included in the labor contract; the fourth section describes main solution between professional football players and the club after a dispute, including the negotiation, the FIFA (DRC) adjudication, the International Court of Arbitration for Sport (CAS) of the arbitration and court decisions, this part trough three cases presented by the dispute to tell us the various organizations is how to solve disputes. The last part describes the status of Chinese professional football labor contract and the relevant legal issues, including the Chinese professional soccer's legal regulation and judicial intervention involvement issues, the different resolution mechanisms between the foreign players and national players with the national club after the dispute, learning from the European Union transfer system and establishment China's transfer system. Study the dispute settlement mechanism from abroad, building China's sports arbitration system and collective bargaining system, greater attention to protecting the interests of the players in the club and to reach a the balance of power between the players and the clubs. In the practice, although we learn more and more transfer system from foreign practice, but there is still a gap, due to the planned economy and the impact of the administrative system, the labor contract of professional football in China is still mainly rely on dispute resolution within the Football Association's Litigation Committee, and in many developed foreign countries have already set up the football sports arbitration system, as well as established the international Court of Arbitration for Sport to resolve the International sports disputes.In this paper, through cases analysis, introduce the transfer system of foreign players, and to tell us if the dispute happened on the labor contract, bodies how to resoled, and through introducing the different dispute settlement mechanism between domestic and foreign players with the club on labor contract, dispute settlement body to learn a variety of dispute settlement mechanisms, explore its advantages, combined with our current practice, to build of professional football player transfer system and the sports arbitration system in China.
