| Water resource is one of the most important in elements of natural and is one ofthe elements of the essential substances for human survival. With the developing ofthe industrialization, urbanization and population increases rapidity, water resourcesshortages become serious. How to protect water resources from pollution, to achievethe sustainable use of resources, is one of the classes in today’s world. Although thenumber of China’s water resources is the sixth in the world, per capita consumptionof2500m3. It looks like if the world has one pot of water, Chinese only have onecup and must to share with13billion people. The result is China’s water resourcesare very scarce. Rational development and full utilization of water resources, takinginto account the economic and ecological environment, related to China’s interestsand long-term interests and the whole society economic development. Therefore,how to establish an effective water management system has caused widespreadconcern in society.The dissertation is divided into four chapters:The first part of the article is the groundwork of the latter, comprised by thecharacteristics, meaning and the expiation on the legal system of water resource. The quantityof water resources in the country is rich, but with the developing of the economicprogress and population growth water supply and demand increasingly sharpcontradiction day by day. Second to fond the problems in the water resources of thelegislation. Then clear water rights trading system can facilitate the furtherimprovement. The third part of the article is mainly on sturdy the water protection legislation inabroad and based to learn the protection of water resources law system, include theUnited States, France, Australia and Japan. On the one hand through the analysis ofoverseas water makes it clear that the legal system to recognize the current waterresources in our country legal system and social apart.
