The Contemporary Legal Value Of "Harmony Between Human And Nature" Traditional Environmental Ethics

In recent years, China is facing some severe natural disasters and otherenvironmental issues.It seriously impedes the healthy development of China. Theseproblems force us to re-examine the relationship between human and nature, and toreflect the negative impact of human’s activities on the nature.From the thinking of the practical problems, this article tries to find the way tosolve these problems.We all kown that the Chinese traditional environmental ethicshave been generated for thousands of years,for example“harmony between humanand nature”、“loving people,love all things”、“self-evolution,self-developent”and soon. Based on many papers and books,the author trims the origin and the evolutiveprocess of the theory“harmony between human and nature”,and the concretemanifestation of the“hamony between human and nature”in China’s ancientenvironmental legislation.Then the author points out that“harmony between humanand nature”is contained organic natural views and zoology ethic thoughts.It is thebest choice of dealing with the relationship between human and nature which hasbeen endowed new theory viewpoints.Combined with the relevant provisions ofChina’s current environmental law, the author analyses that there are some problemson the legislative purpose and legislative principles of our environmental law. China’scurrent environmental law are lack of internal support of environmental ethics, Thesighificance of view of the theory“hamony between human and nature”is a mainresearching part of this paper.This article affirms the academic and practical value of“harmony between human and nature”towards China’s sustainable development.This paper argues that the theory “harmony between human and nature” whichcontains the organic view that everything on earth compose the nature system andzoology equality theory coincides with the western environmental ethics.This articleexplores the modern zoology ethic value of traditional environmental ethics“harmony between human and nature”.To build the sustainable environmental ethics with Chinese characteristics,we must carry on the excellent ancient Chineseecological thoughts.In contermporary condition, the theory“harmony between humanand nature”will guide human to remold the relationship between human andnature,to modify our environmental law, to provide a theoretical draw for thedevelopment of China’s Environmental Law and Environmental Ethics, to improvecitizen’s awareness of environmental ethics,therefore the harmonious,sustainable andhealthy development of human society and nature will be actualized.
